Terms of Service
These terms apply when you subscribe to RealtyWiseAI, and when you interact with a RealtyWiseAI assistant. Last updated August 3, 2026.
1. The agreement
RealtyWiseAI is operated by ChurchWiseAI LTD, a Canadian corporation, under the WiseAI Agency name. By subscribing to the service, or by using it on behalf of a brokerage, you agree to these terms. If you are agreeing on behalf of a brokerage or a personal real estate corporation, you confirm you are authorized to bind it.
2. What RealtyWiseAI is not
RealtyWiseAI is software. It is not a real estate brokerage, not a registrant, and not your agent. We do not represent buyers or sellers, we do not hold trust money or deposits, and we do not give real estate, legal, tax, or mortgage advice.
Nothing the assistant says to a caller is advice from us, and nothing in these terms creates an agency relationship between us and a member of the public. The professional relationship, and the professional obligations that go with it, remain yours.
3. The service
Depending on your plan, the service answers inbound calls and chats, qualifies and records leads, books appointments, sends you alerts, and presents listing information you are entitled to display. We may add, change, or retire features. If a change materially reduces what you are paying for, we will tell you before it takes effect.
We aim for continuous availability but do not promise uninterrupted service. Telephone delivery, speech processing, and language models depend on third parties, and outages happen. Keep a fallback route for callers that does not depend on us.
4. Your obligations
- Stay compliant. You remain responsible for your obligations to your regulator and association — RECO in Ontario, OACIQ in Quebec, BCFSA in British Columbia, or the equivalent where you are registered — and under the CREA REALTOR® Code where it applies to you. Using our software does not transfer any of that to us.
- Configure it truthfully. The name, brokerage, service area, hours, and capabilities you configure must be accurate. Do not configure the assistant to state or imply that it is a licensed registrant, or that it is a human being.
- Handle consent for anything outbound. If you use the service to contact people who did not contact you first, Canada’s anti-spam legislation and telemarketing rules are your responsibility, including consent records and do-not-call obligations.
- Respond to privacy requests. Where a caller asks you about information collected on your line, you are the one who must answer. We will help you retrieve or delete it.
- Keep your credentials secure and tell us promptly if an account is compromised.
5. REALTOR® and MLS® marks
REALTOR®, REALTORS®, the REALTOR® logo, and MLS® are trademarks controlled by The Canadian Real Estate Association. RealtyWiseAI is not affiliated with, endorsed by, or sponsored by CREA.
If you are a member and you use those marks in material the service produces or publishes, CREA’s trademark rules still apply to you — including how the mark is written and where it may and may not appear. We provide the tool; the compliance of what you publish is yours.
6. Acceptable use
You agree not to use the service to:
- mislead anyone about who or what they are dealing with;
- harass, defraud, or discriminate against anyone, including in any way that would breach human rights or fair housing obligations;
- collect information you have no lawful basis to collect;
- attempt to extract our prompts, models, or underlying systems, or to resell the service as your own without a written agreement;
- interfere with the service’s operation or security.
We may suspend an account that is causing harm, and will tell you why.
7. Limits of an AI assistant
The assistant can misunderstand, mishear, or state something incorrectly, and it can do so confidently. Treat its output as a starting point, not a record you can rely on without checking. Review lead details before acting on them, and do not use the assistant as the sole record of anything that matters legally or financially.
The assistant is built to hand off to a human on request, and to say plainly that it is an AI. If you ever see it doing otherwise, tell us and we will treat it as a defect.
8. Fees and billing
RealtyWiseAI is $195 CAD per month. The one-time setup fee is $695 CAD for an individual agent and $995 CAD for a team; brokerage multi-agent pricing is quoted separately. Your written agreement governs if it says otherwise. Subscriptions renew automatically each month until cancelled. Fees are exclusive of applicable taxes.
Payment is processed by Stripe. If a payment fails we may suspend the service after giving you notice. You can cancel at any time, effective at the end of the current billing period. Setup fees are not refundable once provisioning work has started.
We may change pricing on renewal with at least 30 days’ notice. A price change never applies retroactively to a period you have already paid.
9. Intellectual property
The software, prompts, models, configurations, and brand assets are owned by ChurchWiseAI LTD and our vendors, and are licensed to you for the term of your subscription. You keep ownership of your own content: your listings, your branding, and the lead records captured on your line.
You grant us the limited licence needed to operate the service for you — to process your configuration and content, and to store and transmit calls, messages, and leads.
10. Liability
The service is provided on an “as is” basis. To the extent the law allows, we exclude implied warranties, and we are not liable for indirect or consequential loss, including lost commission, lost listings, or lost business opportunity arising from a missed, mishandled, or misrouted contact.
Our total liability in connection with the service is limited to the fees you paid us in the twelve months before the claim arose.
Nothing here limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence.
11. Termination
Either of us may end the agreement on notice. On termination we stop the service and, on request, provide an export of your lead data. After the retention periods in our Privacy Policy, the data is deleted.
Sections that by their nature should survive termination — intellectual property, liability, and governing law — continue to apply.
12. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have jurisdiction.
